Welcome to Glooin (formerly Gloomin) — a cloud-based screen recording and screenshot platform. The terms "we", "us", and "our" refer to Glooin. Glooin operates this platform and website, including all related information, content, features, tools, products and services (the "Services"). Our billing and store infrastructure is powered by Shopify.

These Terms of Service ("Terms") describe your rights and responsibilities when using the Services. Please read them carefully — they include important information about your legal rights, warranty disclaimers, and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy (www.glooin.com/policies/privacy-policy). If you do not agree, please do not use or access our Services.

SECTION 1 — ACCESS & ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and have consented to allow any minor dependents to use the Services on devices you own or manage.

To use the Services, you may be asked to provide information such as your email address and billing details. You represent that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR SERVICES & PRODUCTS

Glooin provides a screen recording and screenshot platform accessible via the Glooin Chrome extension. We have made every effort to accurately represent our Services. We do not warrant that the quality of any service will meet your expectations.

All descriptions of features and services are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any feature at any time. SECTION 3 — ORDERS & PURCHASES

When you place an order or purchase a plan, you are making an offer to purchase. Glooin reserves the right to accept or decline your order for any reason. Your order is not accepted until Glooin confirms acceptance and processes your payment. Please review your order carefully before submitting.

SECTION 4 — PRICES & BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time of purchase as shown in your order confirmation.

You agree to provide current, complete, and accurate payment information for all purchases. Payments are processed securely via Stripe. By completing a purchase, you also agree to Stripe's terms of service (stripe.com/legal). Glooin does not store your full card details on its servers.

SECTION 5 — INTELLECTUAL PROPERTY

The Glooin platform — including all trademarks, brands, text, displays, images, graphics, video, audio, software, and the design and arrangement thereof — is owned by Glooin, its affiliates, or licensors, and is protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal or business use only, within the scope of your plan. You must not reproduce, distribute, modify, create derivative works of, or transmit any material from the Services without our prior written consent.

Glooin's names, logos, product and service names, and slogans are trademarks of Glooin or its affiliates. You must not use such marks without our prior written permission.

SECTION 6 — OPTIONAL TOOLS

You may be provided access to tools offered by third parties as part of the Services, which we do not monitor or control. Such tools are provided "as is" and "as available" without any warranties. Any use of optional third-party tools is entirely at your own risk.

SECTION 7 — THIRD-PARTY LINKS

The Services may contain links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. Complaints regarding third-party products or services should be directed to the relevant third party.

SECTION 8 — RELATIONSHIP WITH SHOPIFY

Glooin uses Shopify for its store front and Stripe for payment processing. Any purchases you make are made directly with Glooin. By using the Services, you acknowledge and agree that Shopify and Stripe are not responsible for any aspect of any transaction between you and Glooin. You expressly release Shopify, Stripe, and their affiliates from all claims arising from your transactions with Glooin.

SECTION 9 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, available at www.glooin.com/policies/privacy-policy. Certain personal information may also be subject to Shopify's Privacy Policy (privacy.shopify.com). By using the Services, you acknowledge that you have read these privacy policies.

SECTION 10 — FEEDBACK

If you submit ideas, suggestions, feedback, reviews, or proposals ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose, including commercial use. We are under no obligation to maintain your Feedback in confidence or to pay compensation for it.

SECTION 11 — ERRORS, INACCURACIES & OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to feature descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to change or update information at any time without prior notice.

SECTION 12 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any regulations, rules, or laws; (c) to infringe intellectual property rights; (d) to harass, abuse, or harm any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited communications; (g) to impersonate any person or entity; or (h) to engage in any conduct that restricts or inhibits anyone's use of the Services.

You also agree not to: upload viruses or malicious code; reproduce, resell, or exploit any portion of the Services; collect personal information of others; spider, crawl, or scrape the Services; or interfere with security features. We reserve the right to terminate your account at any time for violations of these Terms.

SECTION 13 — TERMINATION

We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections covering Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy Policy will survive termination.

SECTION 14 — DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SECTION 15 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL GLOOIN, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES.

SECTION 16 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Glooin, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

SECTION 17 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

SECTION 18 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with the Privacy Policy and any policies posted on this site, constitute the entire agreement between you and us regarding your use of the Services.

SECTION 19 — ASSIGNMENT

You may not transfer or assign this Agreement or any of your rights without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.

SECTION 20 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict of law provisions. You and Glooin consent to the exclusive jurisdiction of the federal and state courts located in Delaware for any claims not subject to arbitration.

SECTION 21 — CHANGES TO TERMS OF SERVICE

We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. We will notify you of any material changes at least 14 days before they take effect. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
